Impose protection to genetic resources

The 2008 amendments impose a requirement that the patent applicant discloses in the application the direct and original sources of the genetic resources. If an applicant is unable to provide the source of the genetic resource then an explanation must be included. Failure to comply could result in either the denial or invalidation of a Chinese Patent.
