New Practice for Submission of Assignment

In the past, for a patent application that was filed by one other than the inventor(s) with the Taiwan Intellectual Property Office (TIPO), submission of an Assignment originally executed by the inventor(s) was required to be completed within fourmonths of the filing date. Nevertheless, according to the latest practice as approved by the TIPO, only a photocopy of the original assignment is needed to complete the filing procedure in Taiwan. According to the new practice that took immediate effect, the original assignment recorded in a foreign Patent Office with respect to the invention seeking patent protection may now serve as an acceptable replacement of the Assignment so long as such Assignment does not distinctly exclude Taiwan. In case the original assignment distinctly excludes Taiwan, a new Assignment indicating transfer of the entire right, title and interest in the invention seeking patent protection, will need to be re-executed by the inventor(s).
