Nanya Technology Corporation and Fujitsu Made a Cross-Licensing Agreement

The biggest computer company in Japan, Futitsu Ltd., has won the lawsuit against Nanya Technology Corporation for infringing semiconductors Patents. Tokyo District Court ruled that the products sold by Nanya Technology Corporation infringed on the patented semiconductors technology of Fujitsu. Nanya Technology has to compensate a hundred million yen (about NTD 2850,000) and stop importing and selling any related products. As a result, Nanya Technology and Fujitsu are considering a cross-licensing agreement but the license fee is confidential.

Nanya Technology also filed a lawsuit to the U.S. District Court in Guam to sue Fujitsu for the infringement on Nanya Technology’s patents by Fujitsu. Meanwhile, Fujitsu accused Nanya Technology of infringing four patents covering DRAM in San José, California in October 2006.

According to Nanya Technology, the decision of Tokyo District Court certainly is in favor of Japanese-based Fujitsu, but the U.S. District Court has not made the any decision yet and Nanya Technology has hired the trial lawyer to handle the litigation in the U.S. In other words, Nanya Technology will try to reach a cross-licensing agreement to solve the problem of being enjoining from importing and selling its products in Japanese; nevertheless, the infringement litigation pending in other countries will continue.
